Land de-agriculturalization and preferential real estate purchase in exchange for a bribe

Four persons, including a court enforcement officer and an entrepreneur, have been detained by the CBA as part of an investigation into invoking influence in local government and state institutions.

Officers of the CBA Regional Office in Poznań, under the supervision of the Wielkopolska Local Division of the Department for Organized Crime and Corruption at the National Prosecutor's Office in Poznań, have been investigating invoking influence in state and local government institutions and undertaking to act as intermediaries in settling cases in exchange for financial gains. The proceedings cover the years 2019 – 2020.

According to the evidence gathered, three entrepreneurs from the Wielkopolskie Voivodeship, acting jointly and in agreement, invoked the influence of the Mayor of the Town and Commune of Września, the Court Enforcement Officer at the District Court in Września, and the Ministry of Agriculture and Rural Development to promptly and positively examine an application for land de-agriculturalization and to ensure preferential purchase of a real property which was subject to a bailiff auction. In return for the “favour”, they expected a share in profits from subsequent transactions on the real estate.

Moreover, as part of the activities conducted, evidence was gathered indicating that the enforcement officer at the District Court in Września had accepted a promise of a financial benefit of PLN 100,000 from one of the entrepreneurs.  The bribe was to constitute “remuneration” in exchange for the cancellation of an auction of real estate valued at PLN 6.5 million.

Based on evidence gathered in the case, officers of the CBA Regional Office in Poznań have detained four persons who already faced charges at the Wielkopolska Field Division of the Department for Organized Crime and Corruption at the National Prosecutor's Office in Poznań. The prosecutor applied non-custodial preventive measures against them, including a bail, a ban on contact and police supervision. The investigation in question was based on evidence gathered by officers of the CBA Regional Office in Poznań.
