Bribes for referrals to foreign missions. Eight detainees

Eight soldiers of the 6th Command Battalion in Kraków have been detained in the course of operations conducted jointly by the Central Anti-Corruption Bureau and the Military Gendarmerie. The detainees are suspected of giving bribes for sending them on a mission to Kosovo.

As a result of a joint operation of the officers of the CBA Regional Office in Kraków and soldiers of the Military Gendarmerie Unit in Kraków, eight soldiers have been detained. All of them were on military duty in the 6th Command Battalion in Kraków.  The unit is part of the 6th Airborne Brigade in Krakow.

Due to the wide range of criminal practices of a corrupt character, the prosecutor's office entrusted the further investigation to the Regional Office of the Central Anti-Corruption Bureau in Kraków.

The detainees have already heard charges in the Military Affairs Division of the District Prosecutor's Office in Kraków. They are suspected of giving, by the intermediary of an identified person, financial advantages to the commander of a military unit - Lt. Col. Marcin M. - in exchange for sending them on a foreign mission to Kosovo as part of the Polish Military Contingent KFOR (Kosovo Force). The amounts in question were PLN 5,000. One of the detainees was additionally charged with submitting false testimonies during the proceedings.

The prosecutor has applied non-custodial preventive measures against the detainees, including police supervision, bail, a ban on leaving the country, and a ban on contacts with the other suspects.

This is a continuation of detentions under this case, where charges have already been
brought against 21 persons suspected of e.g. corruption-related offences. Three of them, including the commander of the 6th Command Battalion in Kraków Lieutenant Colonel Marcin M., are currently in custody.

The investigators continue to analyse the evidence gathered in this case. Let us remind the readers that under Article 229 § 6 of the Penal Code, a perpetrator of an offence, who gave a material advantage (Article 229 § 1 - 5 of the Penal Code) is not liable to punishment if the material or personal advantage or the promise thereof was accepted by a person, and the person who gave the advantage or the promise thereof notified the authority competent for prosecuting the offence of this fact and disclosed all material circumstances of the offence before the authority became aware of them.
