Procurement of implants in breach of regulations

The CBA has sent a notification to the Public Finance Discipline Ombudsman in Białystok in connection with suspected irregularities in the execution of public procurements for the supply of orthopaedic implants and endoprostheses by the Independent Public Health Care Facility (SPZOZ) in Augustów.

The officers of the Control Proceedings Division of the CBA Regional Office in Białystok have conducted an analysis concerning procedures of making and implementing decisions on public procurements for supplies of orthopaedic implants and endoprostheses. The procurements were organised by the Independent Public Health Care Facility in Augustów. The analysis covered the year 2018. The value of the two examined procurements amounted to approximately PLN 3 million.

The results of the conducted activities revealed circumstances indicating a breach of the Act of 29 January 2004 - Public Procurement Law, including a breach of the rules of fair competition and equal treatment of contractors. The findings of the CBA officers indicate that in the appendices to the specification only one entity could meet the parameters.

Due to the irregularities found, the CBA sent a notice to the Public Finance Discipline Ombudsman in Białystok on violation of Article 17(1)(1) of the Act on Liability for Breach of Public Finance Discipline by the Director of the Independent Health Care Institution in Augustów.
