Investigation Supervised by the European Public Prosecutor’s Office
Officers of the Central Anti-Corruption Bureau are conducting an investigation into abuse of power by an employee of the Nowy Sącz City Hall. Financial gain and irregularities in a public tender are suspected. The investigation is supervised by the European Public Prosecutor’s Office.
On October 7, 2025, officers of the CBA Regional Branch in Łódź seized evidence and electronic equipment at the headquarters of the Nowy Sącz City Hall and the Sądecka Agencja Rozwoju Regionalnego S.A. in Nowy Sącz. The activities were carried out at the request of the European Public Prosecutor's Office.
Abuse of Power
Officers from the CBA Regional Office in Łódź are conducting an investigation into abuse of power by a public official, an employee of the local government of the City of Nowy Sącz, between October 29, 2024, and November 12, 2024.
The investigation findings indicate that, in order to obtain financial gain, an employee of the City of Nowy Sącz allegedly perpetrated irregularities in a public tender for the organization and conduct of courses and workshops as part of the project entitled "Development of the Vocational Competence Center in Nowy Sącz."
The project is being implemented under the "European Funds for Małopolska 2021-2027" program. It involves the acquisition of additional qualifications and professional competencies by students and teachers. EU funding for the project amounts to PLN 4,398,192.32.
Acting to the Detriment of the Public Interest
As a result of a number of irregularities in the organization of the tender and the abuse of power by a local government employee, crucial information was allegedly disclosed to one of the bidders. This action could have jeopardized the legally protected interest in the smooth conduct of the public tender, which constitutes acting to the detriment of the public interest, causing damage in excess of €600,000.
The investigation is ongoing
The CBA reminds that under Article 305 §6 of the Polish Penal Code, the perpetrator of an offense who has reported the fact of its commission to a law enforcement agency, a competition authority of a European Union Member State, or the European Commission and disclosed all relevant circumstances of the offense before the law enforcement agency became aware of it, is not subject to punishment.
