Further CBA arrests

Officers from the Central Anti-Corruption Bureau have detained three individuals in the Silesian region. Among those detained are an architect and two representatives of the real estate development industry from Częstochowa. The investigation into the acceptance of financial benefits is being supervised by the Silesian Branch of the Department for Organized Crime and Corruption of the National Prosecutor’s Office in Katowice.

On August 4th and 5th of this year, CBA officers from the Regional Office of the CBA in Katowice detained a woman and two men in the Silesian Voivodeship. This is another procedural action in an investigation concerning the acceptance of financial benefits by the former Deputy Marshal of the Silesian Voivodeship, Bartłomiej S. CBA officers searched the residences of the detainees and secured evidence. Searches were also conducted at the Częstochowa City Hall.

Fourth Procedural Operation

The investigation findings indicate that the detained individuals allegedly provided financial benefits to the former Deputy Marshal of the Silesian Voivodeship, while he was still Vice Mayor of Częstochowa, in exchange for favorable considerations in administrative proceedings. The case concerns, among other things, the introduction of changes to local zoning plans for Częstochowa in favor of developers. This is the fourth procedural action carried out by the CBA Katowice Delegation in the ongoing preparatory proceedings. To date, charges have been brought against 11 individuals.

Preventive Measures

The detainees were brought to the Silesian Branch of the Department for Organized Crime and Corruption of the National Prosecutor’s Office in Katowice, where they were charged under Article 229 § 1 of the Penal Code and Article 305 § 2 in connection with § 3 of the Penal Code. The suspects pleaded guilty to the charges. The prosecutor imposed non-custodial preventive measures, including police supervision, travel bans, and financial sureties ranging from PLN 20,000 to PLN 50,000.

CBA Appeal

The CBA reminds that persons who have been entangled in corruption and have provided financial benefits have the opportunity to benefit from the so-called non-punishment clause, specified in Article 229 § 6 of the Penal Code, which states:

The perpetrator of the offence specified in § 1-5 shall not be subject to punishment if a financial or personal benefit or its promise has been accepted by a person performing a public function, and the perpetrator has notified an authority established for the prosecution of offences and disclosed all relevant circumstances of the offence before the authority became aware of it.

CBA appeals for more people who are witnesses in the case to report to the Regional Office of the CBA in Katowice.
