Corruption in the construction of the expressway

Supervision inspector and the owner of the design office detained by the agents of the CBA from Lublin. They got caught for money extortion for positive acceptances of electricity grid in the construction of the expressway. We know that there is more such cases. We call for reporting to the CBA and using the clause of unpunishability set out in the Criminal Code.

Officers from the Regional Office of the Central Anticorruption Bureau in Lublin detained two people in Ostróda in connection with bribes for the acceptance of electrical engineering at the construction of expressways. One of them is the supervision inspector of one of the major distributors of electricity, and the other is a person who is leading an design-consulting office that was issuing invoices for fictitious work that allowed for the "legalization" of given financial benefits.

Currently the part of investigation implemented by the CBA, supervised by the District Prosecutor's Office in Olsztyn, concerns more than 16 thousand zł bribes for the inspector for issuing opinions on the construction of the expressway S-51 Olsztyn - Olsztynek. The main investor in this case is the General Directorate for National Roads and Motorways, which has signed an agreement to build a route with the general contractor, who in turn hires subcontractors.

The CBA officers from Lublin found out that the supervision inspector for his positive and confirming opinions that the electricity grid is constructed properly and is suitable for operation - demanded bribes. Lack of such opinions would result in not accepting of part of the investment, contractual penalties and even breaking up the agreement. The subcontractor could have been left with nothing, without money for work already done. This dependence was used in this situation by the supervision inspector from Ostróda detained by the CBA.

At the request of the prosecutor's office, the court arrested the detained supervision inspector temporarily.

The CBA has determined that such cases could be many, and this practice could last for months.

The Central Anticorruption Bureau calls for, that the contractors, who gave financial benefit to the supervision inspector in exchange for the positive reception of performed work, should report to the Regional Office of the CBA in Lublin and use the clause of unpunishability set in the article. 229 § 6 of the Criminal Code: „does not punishable by the offender as defined in § 1-5, if the material or personal benefit or the promise thereof were accepted by a person exercising a public function, and the perpetrator informed of the fact the body responsible for law enforcement and disclose all material circumstances of the offense before authority about him to know”.
