The CBA’s request to terminate the mandate of the President of Lublin

The CBA discloses non-compliance with the provisions of the anti-corruption act. The Bureau submits a request to terminate the mandate of the President of the City of Lublin - Krzysztof Żuk.

The CBA has completed the verification of compliance with the prohibitions set forth in art. 4 of the Act of 21 August 1997 on Restrictions on Conduct of Business Activities by Persons Performing Public Functions, the so-called anti-corruption act, by Krzysztof Żuk, President of the City of Lublin, in the years 2014 – 2016.

The CBA officers have revealed that from 1 January 2014 to 21 January 2016 Krzysztof Żuk sat in the supervisory board of the PZU na Życie S.A. insurance company, thus infringing the prohibition stipulated in the Act. Moreover, due to the above fact, he was provided with remuneration/payment in the total amount of PLN 260 thousand.

Pursuant to art. 4 of the anti-corruption act, persons subject to anti-corruption restrictions (e.g. presidents of towns and cities, mayors, vogts) may not sit in the bodies of commercial companies during their term of office.

Art. 6 item 1 of the anti-corruption act provides for an exception from this principle. However, to benefit from the abovementioned provision, it is necessary to satisfy a list of strictly determined requirements. In this particular case, the requirements were not met, e.g. the candidacy of Krzysztof Żuk was submitted by an unauthorised entity, the PZU S.A. company, in which the State Treasury’s shareholding does not exceed 50%.

It is worth noticing that the refusal to sign the control protocol by Krzysztof Żuk neither constitutes an impediment in the accomplishment of the control findings, nor alters the indisputable findings of the CBA.

Pursuant to the anti-corruption act and the Electoral Code, the infringement of anti-corruption prohibitions results in the termination of the mandate of the president of the city. Today, such a request has been submitted to the Council of the City of Lublin.

The CBA has requested to present the information on the manner for and the scope of the accomplishment of the motion to terminate the mandate of Krzysztof Żuk, President of the City of Lublin, due to his failure to comply with the anti-corruption act.
